The desire to escape, to break free from confinement or control, emerges in William Dean Howells’ short story â€Å"Scene,† where the actual tragedy of a suicide victim appears secondary to the importance of the diversion it creates for the characters involved: the Contributor and the residents of the Irish town. Through â€Å"Scene,† Howells conveys the concept of escapism, in its various expressions, as an integral part of life.The idea of escapism makes an immediate appearance. The story’s title implies a place or setting where an incident, real or imagined, may occur or have occurred. The use of one single word for the title, with its lack of a definite article to anchor it to a specific event, or an adjective to determine the scene’s quality or tone, implies freedom of interpretation. In the opening paragraph of the story, the residents of a poor, Irish, coastal town welcome any escape from the reality of the daily grind of their lives. Howell s describes their â€Å"small Irish houses standing miserably about on the flats ankle deep, as it were, in little pools of the tide† (Howells 190). By using personification, Howells ties the residents to the confines of their surroundings. The people, like the houses, appear miserable not only in their shabby appearance but in their mood. Just as the houses remain stuck â€Å"ankle deep† (190) in the remnants of the tide water, their inhabitants seem trapped by the circumstances of their lives, their freedom curtailed. References to â€Å"broken fences,† â€Å"vacant lots,† and â€Å"insulted sign-boards [that] forbade them to trespass† (190) reinforce the poverty and banality of their existence where even the defaced signs forbid exploration and escape. When a local girl does escape her world by drowning herself, a resident remarks, â€Å"It was the best thing she could do† (190). Not only might the reason of her suicide have made life unb earable in such a closed society, but, quite simply saved her from a dull existence. The news of her tragic death and the intention to recover the victim’s body promises a diversion from the dreariness of the townspeople’s lives. Howells describes â€Å"a strange stir of people upon the streets† (190). The words â€Å"strange stir† imply uncommon interest and activity. The â€Å"flying† (190) of children through the streets and the â€Å"fluttering† (190) of women to and fro reinforce this activity; the verbs suggesting a lightness of spirit generated by the welcome distraction. As the title of the story suggests, the people prepare to observe a scene, in this case, the discovery of a girl’s body. The event provides an opportunity to escape from the bleakness of their everyday lives.Howells provides another example of escapism through the character of the contributor. In contrast to the townsfolk, the writer initially evades the reali ty of the dismal Irish town and the growing interest of its people. Immersing himself in the beauty of the autumn morning, â€Å"the contributor moved onward down the street, luminous on either hand with crimsoning and yellowing maples, he was so filled with the tender serenity of the scene, as not to be troubled by the spectacle† (190). The contributor focuses on the surrounding maple trees and the various shades of their deep red and yellow foliage rendered even brighter in the sunlight. A sense of â€Å"tender serenity,† gentle peacefulness, created by his vision, serves to distract the contributor so as not to be â€Å"troubled,† inconvenienced, or disturbed emotionally, by â€Å"the spectacle† of this poor Irish town. The word â€Å"spectacle† implies performance, which in turn places the writer as a spectator, distanced from the real events around him. The fact that only a â€Å"sense,† (190) a partial awareness, of the increasing noi se and movement around him â€Å"penetrated,† (190) forcefully pierced, his consciousness implies how successfully he removed himself emotionally from reality. The very length of the second sentence of the story, over fourteen lines, suggests not only the increasing activity and chaos in the street, but also the contributor’s gradual awareness of the scene as it penetrates his consciousness. His imagination offered him a perfect diversion, a perfect escape, from the real circumstances at hand. Like the people of the town, once aware of the girl’s suicide, the contributor appears to distance himself, thereby escaping, from the true facts and emotions of the event. Howells mocks how â€Å"that literary soul fell at once to patching himself up a romantic story for the suicide, after the pitiful fashion of this fiction-ridden age† (191). The phrases â€Å"fell at once† and â€Å"patching himself up† suggest not only the haste in which he must c reate his fiction but his attempt to bring together the requisite components of a romantic story, as demanded by his readership. He appraises the events in terms of setting and character, finding both disappointing. The bleak setting of the Irish town repulses the romantic writer since it bore â€Å"so slight relation to the French roofs and modern improvements of the comfortable Charlesbridge which he knew† (191). The contributor would prefer a more refined setting for his story, something more engaging for his readers who also desire to escape. Assuming that the girl died in shame, having succumbed to seduction, the contributor begrudgingly labels his character as â€Å"the Fallen Woman† (191) whom he dubs â€Å"a very tiresome figure to the imagination† (191). Clearly, overuse of this type of character in literature has rendered it worthless. The Fallen Woman â€Å"was a spectacle to wring one’s heart,† (191) but seemed â€Å"a fatality† (191) that she be â€Å"the principal personage of this little scene† (191). The words â€Å"spectacle† and â€Å"scene† distance the contributor to that of a spectator appraising a drama, whilst the adjective â€Å"little† sums up his virtual indifference to the tragedy of the real situation: the death, not of a â€Å"principal personage,† but of a young girl. The contributor’s disappointment in and insensitivity to the real facts of the scene reduce him to a mere â€Å"spectator awaiting some entertainment, with a faint inclination to be critical† (191). Together with the earlier use of â€Å"spectacle† and â€Å"scene,† the word â€Å"spectator† once more distances the contributor from a true involvement in the scene. By romanticizing reality, the contributor and his readers look for an escape from the unpleasantness of life. As the contributor creates more details for his story, and the anticipation of t he residents increases with the discovery of the girl’s body, their escapism deepens. Howells describes how â€Å"there passed through the motley crowd, not so much a cry as a sensation of ‘They’ve found her, they’ve found her!’ and then the one terrible picturesque fact, ‘She was standing upright!’† (191). The word â€Å"motley† emphasizes the ordinariness of the crowd, thus, making the details of her discovery more exciting to them. The use of the exclamation marks, together with the word â€Å"sensation,† captures the buzz that spreads through the crowd as it visualizes the striking image of the victim standing upright in the mud. Her position suggests a final defiance of the high-minded who would have shunned her, had she lived. Yet, her escape remains incomplete. The poignancy of the information â€Å"They are bringing her-bringing her in a wagon† (192) seems lost to the contributor and the crowd. The noise and motion of the children in the crowd steadily increases as their excitement grows. In anticipation and excitement of the funeral car’s arrival, Howells describes â€Å"a noiseless riot stirring the legs and arms of the boys into frantic demonstration† (193) until finally they â€Å"could no longer be restrained; they broke out with wild yells and danced madly† (194). Howells’ diction: â€Å"frantic,† â€Å"wild,† and â€Å"madly,† suggests sudden freedom, an escape from restraints. The growing excitement of the children and the distraction of the contributor juxtaposed with the harsh reality of the girl’s carelessly transported body in a grocery wagon highlights the divide between escapism and reality. The simple description of the treatment of her body creates pathos: â€Å"In the bottom of the cart lay something long and straight and terrible, covered with a red shawl that drooped over the end of the wagon; and on this thing were piled the baskets in which the grocers had delivered their orders for sugar and flour, and coffee and tea† (194). I really enjoyed this part of the movie because this was the point where everyone realized that they all had to work together: whites, blacks, and Italians. To me, sticking together is the most important thing to do when you go through hardships in life. Next, the men from the Coal Company started trouble with the people of Matewan again. From the time the two men entered the scene, I didn’t like him. He thought he was better than everyone and had a right to stop the formation of a union. However, later in the movie, it showed that the men from the Coal Company didn’t win the â€Å"battle.† The people of Matewan, once again, stuck together to kill the men from the Coal Company. Peripheral nervous system connections with various organs and structures of the body are established through cranial nerves and spinal nerves. While some cranial nerves contain only sensory neurons, most cranial nerves and all spinal nerves contain both motor and sensory neurons. Function Cranial nerves are responsible for the control of a number of functions in the body. Some of these functions include directing sense and motor impulses, equilibrium control, eye movement and vision, hearing, respiration, swallowing, smelling, facial sensation, and tasting. Facts of Miranda v. Arizona On March 2, 1963, Patricia McGee (not her real name) was kidnapped and raped while walking home after work in Phoenix, Arizona. She accused Ernesto Miranda of the crime after picking him out of a lineup. He was arrested and taken to an interrogation room where after three hours he signed a written confession to the crimes. The paper on which he wrote his confession stated that the information was given voluntarily and that he understood his rights. However, no specific rights were listed on the paper. Miranda was found guilty in an Arizona court based largely on the written confession. He was sentenced to 20 to 30 years for both crimes to be served concurrently. However, his attorney felt that his confession should not be admissible due to the fact that he was not warned of his right to have an attorney represent him or that his statement could be used against him. Therefore, he appealed the case for Miranda. The Arizona State Supreme Court did not agree that the confession had been coerced, and therefore upheld the conviction. From there, his attorneys, with the assistance of the American Civil Liberties Union, appealed to the US Supreme Court. Supreme Court Decision The Supreme Court actually decided four different cases that all had similar circumstances when they ruled on Miranda. Under Chief Justice Earl Warren, the court ended up siding with Miranda with a 5-4 vote. At first, the attorneys for Miranda attempted to argue that his rights had been violated as he had not been given an attorney during the confession, citing the Sixth Amendment. However, the Court focused on the rights guaranteed by the Fifth Amendment including that of protection against self-incrimination. The Majority Opinion written by Warren stated that without proper safeguards, the process of in-custody interrogation of persons suspected or accused of crime contains inherently compelling pressures which work to undermine the individual’s will to resist and to compel him to speak where he would otherwise do so freely. Miranda was not released from prison, however, because he had also been convicted of robbery which was not affected by the decision. He was retried for the crimes of rape and kidnapping without the written evidence and found guilty a second time. The Significance of Miranda v. Arizona The Supreme Court decision in Mapp v. Ohio was quite controversial. Opponents argued that advising criminals of their rights would hamper police investigations and cause more criminals to walk free. In fact, Congress passed a law in 1968 that provided the ability for courts to examine confessions on a case-by-case basis to decide whether they should be allowed. The main result of Miranda v. Arizona was the creation of the Miranda Rights. These were listed in the Majority Opinion written by Chief Justice Earl Warren: [A suspect] must be warned prior to any questioning that he has the right to remain silent, that anything he says can be used against him in a court of law, that he has the right to the presence of an attorney, and that if he cannot afford an attorney one will be appointed for him prior to any questioning if he so desires. Legal positivism finds it roots way back in ancient Christianity. It is believed that the Ten Commandments held sacred and pre-eminent values. When ancient Greeks intended for a new law to have permanent validity, they inscribed it in stone or wood and displayed it public for all to see. Prior to the American Revolution, English political thinkers like John Austin and Thomas Hobbes came up with the command theory of law. This philosophy model said that the only lawful establishments that the Courts should recognize are the commands of the sovereign. This was because only the Sovereign is entrusted with power over the military and police force. Three varied schools of thought emerge in discussion of legal positivism. 1. The Pedigree Thesis: The pedigree thesis asserts that legal validity is a function of certain common truths. Deriving profoundly from Jeremy Bentham, John Austin  [1]  contends that the major characteristic feature of a legal system is the presence of a sovereign who is habitually obeyed by most people living in the society, but not in the routine of observing any specific human superior. Austins assessment, a rule R is lawfully binding (that is, is a law) in a society S if and only if R is directed by the sovereign in S and is backed up with the danger of an approval. The severity of the threatened sanction is irrelevant; any general sovereign imperative supported by a threat of even the smallest harm is a law. For Austins command theory of law there is a need for the existence of identifiable sovereign in self-governing civilizations. In the United States of America, for instance, the final political power appears to belong to the common people, who pick leaders to represent their welfares. The chosen leaders have the authority to compel the behaviour but are regarded as servants of the people and not as repositories of independent power. The polling population, on the other hand, seems to be the source of the final political authority, yet it lacks the immediate power to coerce behaviour. Thus, in democracies like that of the United States, the final political authority and the power to coerce behaviour seems to reside in different entities. However according to the reputable H. L. A. Hart  [2]  , every legal system must contain so-called primary rules that regulate citizen behaviour, a system consisting entirely of the kind of liberty a restriction found in the criminal law is, at best, a elementary or nascent legal system. The Pedigree theory focuses on the specific rule, namely that necessitates citizens to do or abstain from certain actions, whether they wish to or not. On Harts view, Austins stresses on powerful force that leads him to overlook the presence of a second kind of primary rule that confers upon citizens the authority to produce, alter or extinguish rights and obligations in other persons. Hart lays down, the guidelines for leading the creation of contracts and wills cannot plausibly be characterized as restrictions on freedom that are backed by the danger of a approval. These directions allow people to structure their legal relations within the coercive framework of the law-a feature that Hart corre ctly regards as one of laws greatest contributions to public life. The concept relates clearly to a complete monarchy, but it is not vibrant when applied to a society where some group is the sovereign. L. A. Hart argues that the command theory cannot distinguish between a legitimate government and an armed robber (give me your cash or else). The above-mentioned philosophy is completely based on compulsion. Therefore, on Harts opinion, there are two basic situations that are necessary for the existence of a legal system: On one hand those rules of behaviour which are valid according to the systems ultimate criteria of validity must be generally obeyed, and, on the other hand, its rules of recognition specifying the criteria of legal validity and its rules of change and adjudication must be effectively accepted as common public standards of official behaviour by its officials. Harts view is vulnerable to the same criticism that he levels in contradiction of Austins. Hart discards Austins interpretation as the official application of coercive force can no more give rise to an obligation than can the application of coercive enforced by a gunman. Nevertheless the condition is not unlike that, if the gunman takes the internal point of view towards his authority to give rise such to a hazard. Regardless of the gunmans confidence that he is permitted to make the threat, the victim is grateful, but not obligated, to obey the gunmans commands. A gunmans behaviour is no less coercive because he believes he is entitled to make the threat. 2. The Separability Thesis: Legal positivism also finds its explanations in the Separability thesis. In its universal form, is the Separability thesis asserts that law and morality are conceptually distinct. According to this theory only an object-level claim is made about the existence of conditions for legal validity. More commonly, the Separability thesis is interpreted as making only an object-level claim about the existence conditions for lawful legitimacy. For example H.L.A. Hart  [3]  defines it, the Separability thesis is no more than the simple contention that it is in no sense a necessary truth that laws reproduce or satisfy certain difficulties of morals; however in detail they have frequently done. Insofar as the objective level of understanding the Separability thesis denies it, its a necessary truth that there are moral constraints on legal validity, it suggests the presence of a conceivable legal system in which there are no moral constraints on legal validity. 3. The Discretion Thesis: Another theory commonly associated with positivism is the discretion thesis, conferring to which judges resolve problematic cases by making new law in the exercise of discretion. According to this theory a set of valid legal rules is exhaustive in nature and if any persons case is not covered under such a rule, then that particular case cannot be decided by applying that particular law. This gives the judges a quasi-legislative power to create or promulgate a law in circumstances where a case is not covered by a rule and hence the case cannot be decided by interpreting by applying an existing law/rule. Though often associated by positivism, the discretion thesis does not fit into the positivisms hypothetical idea. The pedigree and Separability theories mean to be conceptual claims that are true of every possible lawful arrangement. These two entitlements jointly proclaim that, within in every possible legal structure, the intentions of law are lawful in virtue of having been manufact ured according to some set of social agreements  [4]  . In this regard, there are no ethical restraints on the content of law that hold in every possible legal system. There could be three different senses in which a judge might be said to have discretion: (1) a judge has discretion when she exercises judgment in applying a legal standard to a particular case; (2) a judge has discretion when her decision is not subject to reversal by any other authority; and (3) a judge has discretion when her decision is not bound by any legal standards. Going by these, the discretion thesis is inconsistent with ordinary legal exercise. Even in the greatest problematic cases where there is no clarity appropriate law, lawyers dont request the judge to adapt the relevant issue by making new law. Each lawyer cites cases favourable to her clients position and argues that the judge is bound by those cases to decide in her clients favour. As a practical matter, lawyers hardly, if ever, acknowledge th ere are no legal morals governing a case and ask the judge to legislate in the exercise of discretion. 4. Conclusion: I conclude by saying that the modern rules in relation to particular place or people were mostly traced or taken from the past rules or from another lawful organization. All the contemporary laws have its individual creation, the issue of conflict of positivists view and historical interpretation is not as real as it thought. The most influential criticism of legal positivism all flow from the suspicion that it fails to give principles its due. The law has significant tasks like bringing harmony and peace in our lives, preceding the common good in safeguarding human rights, or to rule with honesty and therefore it has more relevance with our morals. A. Lon Fuller denies the separation of law and morality. He considers that all the good qualities and characteristics flow by clear consistent and open practices, which can be found not only in law but also in all other social practices in which those features including custom and positive ethics prevail. Further he reproaches that if law is a matter of fact then we are without an explanation of the duty to obey. If amoral law is made there is an obligation to obey.
